New Year – New Legislation

The beginning of the year of 2010 was marked with some important legislative acts, which have changed life conditions and functioning of individuals and legal entities.

1. Benefits monetization

The legislative act “On the form of providing social support in payment for accommodation and utility services in St. Petersburg” No 228-45 from May 21, 2009.

Came into force on 01.01.2010

Payment discounts for accommodation and utility services => monetary payments

The monetization will be made before the date of payments for accommodation and utility services.

The low will refer to all categories of citizens receiving social benefits, except for Heroes of the Soviet Union, of the Russian Federation, and full Cavaliers of the Order of Glory, their widows and parents, as well as for orphans and children deprived of parental care. For those categories, benefits will be retained.

The number of citizens involved in the low is estimated at 1 million people.

Benefits monetization in the sphere of housing and public utilities continues the one began in 2005 in the sphere of transportation, pharmacological support, and health resort treatment (see Federal low No 122-FZ from 22.08.2004).

2. Valorization

The legislative act "On the retirement pensions in the Russian Federation” No 173-FZ from December 17, 2001. Edition from 24.07.2009 (Federal act No 213-FZ).

Came into force on 01.01.2010

Notional pension capital as of 01.01.2002 is raised

The notional pension capital as of 01.01.2002 will be raised 10%, in addition it will be 1% raised for each full year of labor experience, obtained by 01.01.1991.

3. Home arrest

The legislative act “On alteration of separate legislative acts of the Russian Federation in relation to the introduction into operation of regulations of the Criminal Code of the Russian Federation and the Correctional Code of the Russian Federation on the punishment in the form of restraint of liberty” No 377-FZ from December 29, 2009.

Came into force on 01.10.2010 (art. 6 and 7 – 10.01.2010)

New form of “soft” out-of-prison criminal punishment

“Restraint of liberty: - do not go outside of the accommodation (flat, other living quarters) in specified time of the day, - do not come to specified places within the limits of the territory of the corresponding municipal entity, - do not go outside the limits of the territory of the corresponding municipal entity, - do not visit the places of mass events or other events, and do not take part in the specified events, - do not change the place of residence or habitation, place of work and (or) study without sanction of specialized state institution controlling the service of sentence of convicts in the form of restraint of liberty.”

Term:
2 months - 4 years
main type of punishment for crimes of little gravity and crimes of medium gravity;
6 months - 2 years
additional type of retrain of liberty punishment.

In case of the aforementioned measure of punishment, the supervisory authorities have a right to use audio-visual, electronic, or other technical means of watch and control.

4. The Tax Code amendments

The legislative act “On introduction of amendments to separate legislative acts of the Russian Federation and cancelation of separate legislative acts (statements of legislative acts) of the Russian Federation in relation to adoption of the Federal Low “On the insurance contribution to the pension fund of the Russian Federation, Federal Compulsory Medical Insurance Fund and regional Compulsory Medical Insurance Funds” No 213-FZ from 24.07.09.

The possibility for regional authorities to raise the transport tax rate 10 times (earlier – 5 times) is provided

The present legislative action caused the storm of protest from the side of the citizens. The St. Petersburg government decided not to raise the transport tax rate in the year of 2010.

The consolidated social tax (CST) is canceled

The return to the 10-years-old tax system, the CST introduction experience is recognized unsuccessful. Instead of the consolidated social tax, the payments are to be send to Pension Fund of the Russian Federation, Social Insurance Fund of the Russian Federation, and Compulsory Medical Insurance Funds.

5. Self-Regulatory Organization (SRO)

The legislation act “On amendments to the Town-Planning Code of the Russian federation and separate legislative acts of the Russian federation” No 148-FZ from 22.07.2008.

The amendments referring to the licensing of projection, research and construction activities came into force on 01.10.2010.

The construction licenses are canceled. To fulfill research, projection and construction works, companies are to belong to self-regulatory organizations (SRO).

The success of the present legislative action realization cannot be seen fast - there are the quiet conditions on the construction market now.

6. Personal data

The legislative act “On the personal data” No 152-FZ from 27.07.2006.

The information systems of personal data are to be brought into compliance with the requirements of the legislative acts not older than 01.01.2010, in particular with the following:

…the prohibition of data bases of information systems of personal data (ISPD), created for incompatible purposes… …storing of personal data (PD) is to be conducted in the form allowing to define the PD subject, not longer than it is required by the purpose of their processing, and the PD are subjected to erasure after the processing purposes are reached or the necessity of those purposes is lost… …the PD subject has the right to claim for his PD clarification from the operator, the PD blocking, or erasure in case of the PD are incomplete, old, unreliable, illegally acquired, Or they are not necessary for the announced processing purpose… …the use and storing of biometrical PD outside the ISPD can be made only on such material objects and with the help of such storing technology, which provide the security of the data from unauthorized or accidental access, erasure, change, blocking, copying, distribution…
